Guaran tee and Compensation

Barco provides a guarantee relating to perfect man ufacturi ng as part of the legally stipulated terms of guarantee. On receipt, th e pu rchaser

mu st immediately inspect all delivered goods for damage in curred during transport, as well as for material and manufacturing faults Barc o

must be informed immediately in writing of any c omplaints.

The period of guarantee begins on the date of transfer of risks, in the case of special systems and software on the date of c omm issioning,

at latest 30 days after the transfer of risks. In the even t of justiﬁed notice of com plaint, Barco can r epair the fa ult or p rovide a replacement

at its own disc retion within an a ppropriate period. If this m easure proves to be impossible or unsuccessful, the purchaser can demand a

reduct ion in the purchase price or cancellation of the contract. All other claims, in particular those relating to c ompensation for d irect or

indirect damage, and also damage attributed to the operatio n of s oftware as well a s to o ther services provided by Barco, being a component

of the system or independent service, will be deemed in vali d provided the dam age is n ot pro ven to be attributed to the absence of properties

guaranteed in writing or due to the intent or gro ss negligence or p art of Barco.

If the purchaser or a third party carr ies out modiﬁcations or repairs on goods delivered by Barco, or if the goods are handled inc orr ectly,

in parti cular if the systems are commissioned operated incorrectly or if, after the transfer of risks , the goods are subje ct to inﬂuences not

agreed upon in the con tract, all guarantee claims of the purchaser will be rendered invalid. Not included in the guarant ee coverage are

system failures which are attributed to p rograms or special electronic circuitry pr ovided by the pur chaser, e. g. interfaces . Normal wear as

well as norma l maintenance a re not subject to the guara ntee provided by Barco either.

The environmental conditions as well as the servicing and m aintenance regulations s peciﬁed in the this manual must be com plied with by

the customer.
