Guaran tee and Compensation
Barco provides a guarantee relating to perfect man ufacturing as part of the legally stipulated terms of guaran tee. On receipt, the pu rchaser
mu st immediately inspect all delivered goods for da mage incurred during transport, as well as fo r material and manufact uring fau lts Barc o
must be informed immediatel y in wr iting of any c omplaints.
The period of guarantee begins on the date of transfer of risks, in the case of special systems and sof tware on the date of c omm issioning,
at latest 30 days after the transfer of risks. In the event of justified notice of com p laint, Barco can r epair the fault or p r ovide a replacement
at its own disc retion within an appropriate period. I f this m easure proves to be impossible or unsuccessful, the purchaser can demand a
reduction in the purchase price or cancellation of the contract. All other claims, in particular those relating to compensation for direct or
indirect damage, and also damage attributed to the operation of s oftware as well as to o ther service s provi ded by Barco, being a component
of the system or independent s ervice, will be deemed inval id provided the dam age is n ot pro ven to be attribut ed to the abse nce of properties
guaranteed in writing or due to the intent or gross negligence or p art of Barco.
If the purchaser or a third party carries out modifications or repairs on goods delivered by Barco, or if the goods are handled inc orrectly,
in particula r if the systems are commissioned operated in correctly or if, after the transfer of risks , the goods are subj ect to i nfluences not
agreed upon in the contract, all guarantee claims of the purchaser will be rendered invalid. Not included in the guarantee coverage are
system failures which are attributed to programs or sp ecial elect ronic circuitr y p r ovided by the pur chaser, e.g. interfaces. Normal wear as
well a s norma l maintenance a re not subject to the guara nte e provided by Barco either.
The environmental conditions as well as the servicing and maintenance regula tions s pecified in the this manual must be com plied with by
the customer.
