Grundfos AQtap Water Management System
Description of the system
The Water Management System (”WMS”) is an application that can be accessed from your
smartphone, tablet or computer. The application is a part of the solution that allows people to
tank clean water on request from water kiosks. WMS is an application made for water service
providers and the application processes and publishes data from transactions and operations
through Grundfos AQtap. Grundfos AQtap is an intelligent water dispenser that can be used
at any water kiosk. It’s simple and intuitive to use, and water consumers pay for the water via
a WaterCard. The use of smart cards for revenue collection is transparent and reliable for the
consumers and efficient for the water service provider.
When you login to the application as a water service provider you can appoint your employees
as additional users of the WMS and ights. The WMS gives you give them different access r
access to see which users have tapped water at which water kiosks administrated by your
water plant and at which times. In addition, you can administrate the configuration of the water
points and see an overview of the distribution and consumption of water credits.
Terms and conditions relating to the use of WMS
Failure of the system
If WMS fails GRUNDFOS will apply reasonable commercial measures in re-establishing
WMS.
The aim is to make WMS available at a service level of:
- Phone/online support: Available in standard business hours
- Critical failure: max. 8 hours in standard business hours
- High importance: max. 2 working days
- Medium importance: max. 10 working days
- Low importance: At next planned update
GRUNDFOS takes no responsibility for missing availability that lies outside its control (e.g.
network failures).
Maintenance of the system
GRUNDFOS will from time to time use service windows where GRUNDFOS takes WMS down
for maintenance during which WMS is unavailable. GRUNDFOS will announce such service
windows in advance to the water service provider whenever possible. This, however, is not
always possible hence GRUNDFOS reserves the right to take WMS out for service without
prior warning to the water service provider. GRUNDFOS will make a reasonable effort in
keeping service windows as short and few as possible. GRUNDFOS assumes no liability for
any loss incurred by the water service provider or any third party in relation to such service
window.

Administration of users and data in the system
It is the water service provider that through the built-in user management facilities administers
all users and their access and rights to WMS. The water service provider is responsible for
getting the necessary consents from the employees that are made users of the system. Users
must in order to gain access to WMS acquire a Grundfos Global Login account and accept the
pre-requisite general terms and conditions of Grundfos Global Login.
The water service provider owns its own data and is the data controller of the data.
GRUNDFOS is granted access to the water service provider’s data for development purposes
and in anonymized form for marketing and demonstration purposes. The water service
provider is itself responsible for obtaining a copy of data through features in WMS allowing
data downloads. Data is stored inside EU. The water service provider shall as the owner of
the data and as the data controller be responsible for all personal data uploaded in the WMS
and its protection, including getting the necessary consent from the persons, whose data are
uploaded.
It is explicitly agreed that the nt of view suited to store personal WMS is not from a security poi
data, and that the water service provider shall take all necessary precautions in this respect.
GRUNDFOS will not generate or treat the incoming information in WMS, and shall in this
respect only be considered as a data processer.
Under no circumstances shall GRUNDFOS be liable for the correctness of the incoming data
in WMS, why it cannot be liable for any functional and/or economic claim arising therefrom.
Personal data
You agree that Grundfos may collect your first and last name, your email address, user type
and language setting, that you provide to us when creating a user profile in the Application or
otherwise given when using the Application. You agree that Grundfos may process the
personal data provided by you in connection with your use of the Application with the purpose
of delivering the services of the Application requested by you.
Before designating any employee or agent as a user, you as the water service provider agree
to ensure that each user of the system gives his/her consent to the collection of his/her
personal data for the purpose of being a user of the WMS and that access to the WMS will be
allowed to him or her only upon agreeing to these terms.
Grundfos will not store, transfer or in any other way process your personal data outside of this
specific purposes mentioned above.
Grundfos Holding A/S is the data controller and responsible for data security for the collected
information and can sh er companies in the are it with Microsoft Danmark Aps and oth
Grundfos Group for the specific purposes mentioned above.
You have the right to inquire about the information that Grundfos has recorded about you and
to object to recorded information under the regulations in the Danish Act on Processing of
Personal Data. If the information is incorrect, incomplete or irrelevant, you are entitled to have
the information corrected or deleted. If you would like to know

SCHEDULE 1
DATA PROCESSING AGREEMENT
The Parties agree that any processing of Personal Data shall take place in accordance with this
schedule (hereinafter referred to as “Schedule”).
1. DEFINITIONS
1.1 “Applicable Data Protection Law” shall mean the legislation protecting the fundamental
rights and freedoms of individuals and, in particular their right to privacy with respect to the
Processing of Personal Data applicable to Controller and Processor; the term Applicable Data
Protection Law shall encompass the GDPR as of May 25, 2018.
1.2 “GDPR”
shall mean the General Data Protection Regulation: Regulation (EU) 2016/679 of the
European Parliament and of the Council of April 27, 2016 on the protection of natural persons
with regard to the Processing of personal data and on the free movement of such data which
will apply as of May 25, 2018.
1.3 “Customer” shall mean the water service provider signing up to the WMS who is then able to
appoint own employees and End-users of the WMS.
1.4 “Digital Services” shall mean various Grundfos digital services available through Grundfos
Global Login Account, including WMS.
1.5 shall mean the end-users signing up for the Digital Services. “End-User”
1.6 “Party” shall mean Customer or Grundfos Holding A/S, jointly described as the “Parties”.
1.7 “WMS” shall mean Water Management System.
1.8 The terms "personal data" (hereinafter “Personal Data”), "process/processing", "controller"
(hereinafter “Data Controller”), "processor" (hereinafter “Data Processor”), "data subject",
"supervisory authority", "technical and organisational measures" and "personal data breach"
as used in this Agreement shall be understood in accordance with Applicable Data Protection
Legislation, including the GDPR.
2. SCOPE OF THE DATA PROCESSING
2.1 Grundfos Holding A/S is the Data Controller of Personal Data collected when a person signs
up to the Digital Services. The Personal Data collected at sign up may include first and last
name, company, country/area, email address, areas of interest and job role. The Personal
Data is collected and processed by Grundfos Holding A/S for the purpose of delivering the
Digital Services to the Customer (and End-Users accessing the Digital Services), including
administer use, personalize experience and otherwise support, improve use of or develop the
Digital Services or other services (“the Grundfos Purpose”). In relation to the Grundfos
Purpose, the Customer is the Data Processor on behalf of Grundfos Holding A/S to the extent
the Customer gets access to the personal data through the Digital Service(s) as part of being
able to deliver the Digital Service(s) to End-users. As Data Processor the Customer shall
process the data in compliance with the Grundfos Purpose.
