ii.the Goods have onlybeen operated under normal operating
conditions andhave only been subject tonormal use (and in
particular the Goods must have been correctly connected and
must not have been subject to high voltage or to ionising
radiation and must not havebeen used contrary to the
Companys technicalrecommendations);
iii.theGoods arereturnedto theCompanys premisesat the
Purchasers expense;
iv.anyGoods orparts of Goods replaced shall become the property
of the Company;
v.no workwhatsoever (otherthan normal and proper
maintenance)has been carried out to the Goods or any part of
theGoods withouttheCompanys priorwrittenconsent;
vi.the defecthas not arisen from adesign made, furnished or
specifiedby the Purchaser;
vii.the Goods havebeen assembled or incorporated intoother
goodsonlyinaccordancewith any instructionsissuedby the
Company;
viii.the defecthasnot arisen froma design modified bythe
Purchaser;
ix.thedefecthas not arisen froman item manufactured bya person
otherthantheCompany.Inrespect ofany itemmanufactured by
aperson other thanthe Company, the Purchaser shall only be
entitledtothebenefitofany warranty orguarantee providedby
suchmanufacturer totheCompany.
b.Inrespectofcomputersoftwaresuppliedbythe Companythe
Companydoesnotwarrant that theuseof thesoftwarewillbe
uninterrupted or error free.
c.The Company accepts liability:
(i)for deathorpersonal injurytotheextent that itresults from
the negligence ofthe Company, its employees (whilst in the
course oftheiremployment)oritsagents(inthecourseof the
agency);
(ii) forany breach by theCompany of anystatutory undertaking
asto title,quietpossessionandfreedomfromencumbrance.
d.Subject to conditions (a) and (c) from the time of despatch of the
Goods from the Companyspremises the Purchasershall be
responsible forany defectin the Goods orloss,damage, nuisance or
interferencewhatsoever consequential economic or otherwise or
wastage of materialresultingfrom or causedby or totheGoods.In
particular the Company shall not be liable forany loss of profits or
othereconomic losses.TheCompany accordinglyexcludesallliability
for thesame.
e.At the requestand expense of the Purchaser the Company willtest the
Goods to ascertain performance levels and provide areport ofthe
resultsofthattest. The reportwillbeaccurate atthetimeofthetest,
to the best of thebeliefandknowledge oftheCompany,andthe
Company accepts no liability in respect of its accuracy beyond that set
out in Condition (a).
f.Subject to Condition(e) no representation, condition, warrantyor
other term, express or implied (by statuteor otherwise) is given bythe
Company that the Goods are ofany particular quality or standardor
will enablethe Purchaser to attainany particular performance or
result, or will be suitable for any particular purpose oruse under
specific conditionsor will provideany particular capacity,
notwithstanding that the requirement forsuch performance, result or
capacity or that such particular purpose or conditions mayhavebeen
known (or ought to havebeen known) tothe Company, its employees
or agents.

you informedof any productdesignimprovementsormodifications,itis
importanttocompletethewarrantyregistrationonline.Additionally, if you

Sonifex Warranty & Liability Terms & Conditions
1. Definitions
‘theCompanymeansSonifex Ltd andwhererelevantincludescompanies
withinthesame groupofcompaniesasSonifex Limited.
‘the Goods’ means the goods or any part thereof supplied bythe Company
andwhererelevant includes: workcarried outby the Companyon items
supplied bythePurchaser; services supplied by the Company; and software
suppliedbythe Company.
‘the Purchaser’ means the person or organisation whobuys or has agreed to
buy the Goods.
‘the Price’ means the Price of the Goods and any othercharges incurred by
the Company inthe supply of the Goods.
‘the Warranty Term’ is the length of the product warrantywhich is usually 12
monthsfromthedate ofdespatch; exceptwhentheproducthasbeen
registeredat the Sonifex website when the Warranty Term is 24 months from
thedate ofdespatch.
‘the Contract’ means the quotation, these Conditions of Sale and any other
document incorporatedin a contractbetween the Company and the
Purchaser.
This is the entire Contractbetween the parties relating to the subject matter
hereofandmay not be changedorterminatedexcept inwritingin
accordance with the provisions of this Contract. A reference tothe consent,
acknowledgement, authority or agreement of the Company means in writing
andonlybya directorof theCompany.
2. Warranty
a.The Companyagrees torepairor(atitsdiscretion)replaceGoods
which are foundto be defective(fairwear and tear excepted)and
which are returned tothe Company within the Warranty Term provided
thateachofthefollowingare satisfied:
i.notificationof any defectisgivento theCompany immediately
uponitsbecomingapparentto the Purchaser;
g.(i)To the extentthattheCompany isheldlegallyliableto the
Purchaserforany singlebreachofcontract, tort, representation
or other act or default, the Companysliabilityfor the same shall
not exceedthe price of the Goods.
(ii)The restriction of liability in Condition (g)(i) shall not apply to any
liability accepted by the Seller in Condition (c).
h.Where the Goods are sold under a consumer transaction(as defined by
theConsumer Transactions(Restrictions onStatements) Order 1976)
the statutory rights of the Purchaser are not affectedby these
Conditions of Sale.
Unpacking Your Product
Eachproduct is shipped in protective packaging and should be inspected for
damagebefore use. If there is any transitdamage take picturesofthe
product packagingand notify the carrier immediately with all the relevant
details of the shipment. Packing materials should be kept for inspection and
alsofor iftheproduct needsto be returned.

temperaturevariation (<0°C, >50°C), moisture, dust orvibration.
This apparatus shall not be exposed to dripping or splashing, andno objects
filled withwater, such as vases shall beplaced on the apparatus.
