Guaran tee and Compensation

Barco provides a guarantee relating to perfect man ufact uring as part of the legally stipulated terms of guarante e. On receipt, the pu rchase r

mu st immediately inspect all delivered goods for damage in curred during tra nsport, as wel l as for material and manufacturing faults Barc o

must be inf ormed immediately in writing of any c omplaints.

The period of guarantee beg ins on the date of transfer of risks, in the case of special systems and software on the date of c omm is sioning,

at latest 30 days after the tr ansfer of risks. In the event of justiﬁed notice of com plaint, Barco can r epair th e fault or p rovide a replacement

at its own disc retion within an appropriate period. If this mea sure proves to be impossible or unsucces sful, the purchaser can de mand a

redu ction in the purchase price or cancellation of the contra ct. All other claims, in pa rticular thos e relating to compensation for direct or

indirect damage, and als o damage attributed to the opera tion of s oftware as w ell as to other services provided by Ba rco, being a component

of the system or inde pendent serv ice, will be d eemed invalid provided the da m age is n ot pro ven to be attributed to the absence o f properties

guaranteed in wr iting or due to the intent or gross negligence or p art of Barco.

If the purchaser or a third party carries out modiﬁcations or rep air s on goods delivered by Ba rco, or i f the goods are handled incor rectly,

in particular if the sys tems are ope rated incorrectly or if, after the t ransfer of risks, t he goods are subject to inﬂuenc es not agreed upon in

the contrac t, all guarantee claims of the purchaser will be re nder ed invalid. Not included in the guarantee coverage ar e sy stem failures

which are attr ibuted to programs or special electronic cir cuitry provided by the p urchaser, e.g . interfaces. Normal wear as w ell a s normal

ma intenance are not subject to the guarantee p rovid ed by Barco either.

The environmental conditions as well as the servicing and m aintenance reg ulations s peciﬁed in this m anual must be complied w i th by the

customer.
